This Privacy Policy and such applicable Terms of Service or Terms of Use (together, the “Agreement”) comprise the entire agreement and understanding between you and Brother with respect to your access to and use of the Sites and Services.

Collection of Personal Information

The following is a description of our data collection practices, including the personal information we collect, the sources of that information, the purposes for which we collect information, and whether we disclose that information to external parties.

Personal Information is any data that can be used to identify an individual.

Personal Information: The Personal Information that you may be asked to provide when creating an account, registering, utilizing the Sites or Services, leaving a product review, contacting customer support, or completing a transaction, may include, but not be limited to, your first and last name, mailing address (including ZIP code), e-mail address, username, billing contact information, and telephone.

Sensitive Information: We may collect sensitive information including but not limited to gender, race, financials, and account login.

Payment Information: When purchasing the Services or products online, you will be asked to provide payment information.

Social Media: We collect your social media handle and basic account information when you interact with our services through social media.

Numerical Identifier: We collect a unique numerical identifier which is automatically assigned to you by a first-party cookie when you use our Site, to identify you, provide our Services, keep you logged in to our Site, prevent fraud, and provide you with targeted information and offers.

Geolocation Data: We may collect certain information about your access to and use of the Sites and the Services, such as the name of the Internet service provider and the Internet Protocol (IP) address through which you access the Internet, the dates and times that you access the Sites, and the Services, the pages that you view while at the Sites, information on how you interact with the Sites, and the Internet address of the website from which you linked to the Sites. Information regarding your computer system configuration and operating system is also gathered. This information is used by us to help analyze trends, enhance your experience on the Sites, send targeted advertisements, and to improve and administer the Services.

Commercial Information
: Brother and its affiliates may also collect information from and about your use of our products and the devices connected to the products including, but not limited to, the printer model, serial number, Device ID, the device location, usage data and operating information (collectively, “ Device Data”). Our collection of Device Data is enabled by the software embedded in our products. You may opt-out of such collection by following the instructions in the End User License Agreement for the software. We use this information to monitor your use and the effectiveness of our Services, to identify you, and to provide you with targeted information and offers.

Testimonials: We also display personal testimonials of customers on our Sites in addition to other endorsements. If you wish to update or delete your testimonial, please submit your request through the Consumer Data Request Form(Opens in a new tab).


Promotional Materials
: If you receive newsletters or promotional e-mails from us, we may collect additional information about you through the use of and interaction with customized links or similar technologies to determine whether the e-mail was opened and for how long, and which links were utilized by you, in order to provide you more focused e-mail communications or other information. We may also use third party service providers for these data collection and delivery activities.

Use of Personal Information

Provision of Services: Brother may use your Personal Information to deliver and provide the Services you request, provide you with more effective customer service, to improve the Sites and the Services, and to make the Sites easier to use by eliminating the need for you to repeatedly enter the same information, or by customizing the Sites and Services to your preferences or interests, among other uses.

Registration Information: We use your registration information to validate users, manage subscriptions, recall user settings (address book etc.) deliver Services, support, and improve the Services, and for our internal process evaluations. You may abandon registration at any time before completing the registration process.

Promotional Purposes: With regard to Personal Information that is collected during the registration process from our users, upon completion of the registration process, user will receive email correspondence which provides the user the option not to receive communications from Brother regarding its Services and other product information. If you do not wish to receive such communications, you may opt-out or unsubscribe per this email. We present the OPT-OUT option to users in all marketing communications, except for system or service notifications, such as receipts, confirmation emails and customer service updates that are considered necessary to provide the Services to you.

Processing Payments: The payment information that you provide when purchasing products or the Services is used only to facilitate payments and transactions.

Surveys and Contests: Occasionally we may invite you to participate in surveys or contests. Participation in these surveys or contests is completely voluntary and the user therefore has a choice of whether or not to disclose Personal Information. The requested Personal Information usually includes contact information (such as name and shipping address), and demographic information (such as zip code), but the specific Personal Information collected in any survey may vary. Personal Information will be used by the contest or survey sponsors to notify the winners and award prizes and as otherwise provided in the applicable contest rules. You should carefully review the rules of each survey or contest in which you participate, as they may contain additional important information about Brother’s or a sponsor’s use of your Personal Information. To the extent that the terms and conditions of such rules concerning the treatment of your Personal Information conflict with this Privacy Policy, the terms and conditions of such rules shall control. We will not share the Personal Information you provide through a contest or survey with other third parties unless we give you prior notice and choice.

Social Media: We use data collected through social media to improve our services, respond to your requests or complaints, and send information and advertisements to you.

SMS Messages: If you opt in to receiving delivery status updates for your order via SMS, you consent to us using the telephone number you have provided in connection with your order for this purpose. We may also share your phone number with service providers who facilitate the updates. Messaging and data rates may apply.

Consolidated User Data: Brother may combine your Personal Information with data collected about your activity on our Sites and Services using Tracking Technologies, Device Data, and, if you register for an account, your registration information (the “Consolidated User Data”). We will use and share your Consolidated User Data for the purposes described elsewhere in this Privacy Policy and for the purpose of customizing your user experience on the Sites and Services by targeting advertisements, offerings, and content to your interests. Brother will use your Consolidated User Data on the Sites, Services, and applications, and not for purposes of tracking your activity on the Internet.

User Preferences: We may use your information to analyze your actual or likely preferences through a series of computer processes. On some occasions, we may add our observations to your internal profile. We use this information to gauge and develop our marketing activities, measure the appeal and effectiveness of our services, applications, and tools, and to provide you with targeted information, advertisements, and offers.

Disclosure and Sharing of Your Personal Information

Brother may disclose user Personal Information in the following ways:

  • To comply with any law, regulation, or litigation; or,
  • To protect and defend the property rights of Company and its affiliates; or,
  • To act in urgent circumstances to protect the personal safety of any officer, director, employee, consultant, agent or representative of Company, any user of Company products or services including without limitation the Site and the Services, or any member of the public; or,
  • For reasons of national security, law enforcement or other issues of public importance.
  • In the event Company goes through a business transition or transaction, such as a merger, acquisition by another company, or sale of all or a portion of its assets, in which case user Personal Information will likely be among the assets transferred. You will be notified via email and/or prominent notice on our Web site for 30 days of any such change in ownership or control of your Personal Information.
  • We may also disclose your Personal Information to any other third party with your prior consent.

Brother may share your information with:

  • Service Providers : Our contractors, service providers, and other third parties we use to support our business may have access to your information to help carry out the services they are performing for us, such as: creating, maintaining, hosting, and delivering of our Site and our Services; conducting marketing, handling payments, order fulfillment; administering contests; conducting research and analytics; gathering information you provide in connection with your inquiries; and customer service.
  • Partners : Depending on the partnership, we may share certain information including contact information (at your direction), identification and demographic information, transactional information, user-generated content that you provide, research and feedback, device information and identifiers, connection and usage information, public and commercial information, and social media information. Partners may use your information pursuant to their own policies.
  • Social Media Networks : We may share your information with social media networks for example, if you click on a Facebook “like” button on our Site, the “like” may appear on your Facebook account. Or you may choose to share information directly on these networks using plug-ins for sharing. To control this sharing of information, please review and adjust your privacy settings for the relevant social media network. Depending on your privacy settings and actions on such network, we may share contact information, identification and demographic information, user-generated content, device information and identifiers, connection and usage data, and social media information.
  • Advertisers, Advertising Networks, and Other Third Parties : We may share information about how you use the Services and interact with content or ads to better tailor services, products, marketing, and advertising on our Services and on third-party platforms. To enable these purposes, we may share certain demographics information, device information and identifiers, connection and usage data, geolocation data, public and commercial information, and social media information.

 

Updating Your Personal Account Information

If you are a user who registers an account with us, you may amend or update inaccurate or incomplete Personal Account Information, request deletion of such Personal Account Information, or request that we no longer use it. If your Personal Information changes, it is your responsibility and obligation to update it within your Account. If you wish to change, review, delete or update your Personal Account Information, you can do so by logging onto your “My Account” page. You can access or update your Personal Account Information and communication preferences we have on file. Security of Your Personal Information

We are committed to protecting the security of your Personal Information. We use a variety of security technologies and procedures to help protect your Personal Information from unauthorized access, use or disclosure. For example, we store the Personal Information you provide to us on computer servers with limited access by others. When you transmit sensitive Personal Information (such as a credit card number) over the Internet, this information is transmitted through the use of Secure Socket Layer (SSL) encryption or other technologies. The Personal Information that you provide to Company in connection with registering as a user of the Site or the Services (such as your name and e-mail address) is protected in several ways. For example, your access to your registration information is available through a password and a unique customer ID which is a valid e-mail address provided by you. This password is encrypted. We recommend that you do not divulge your password to anyone. In addition, your registration information resides on secure servers accessible to only selected Company personnel. Tracking Technologies

We and our marketing partners, affiliates, or analytics or service providers, use technologies such as cookies, beacons, tags, scripts, or similar technologies to analyze trends, administer the Sites, track users’ movements around the Sites, and to gather demographic information about our user base as a whole. We may receive reports based on the use of these technologies by these companies on an individual and aggregated basis.

One of the primary purposes of cookies is to help the Sites recall your information about you to deliver relevant content and ease navigation when you return to the Sites. Users can control the use of cookies at the individual browser level. If you reject cookies, you may still use our Sites and Services, but your ability to use some features or areas of the Sites and Services may be limited.

In addition to cookies, the Site gathers certain information about users automatically that is stored in log files. This information includes IP/Internet address of your computer, your browser version, referring URLs and general web visitor information used by our web traffic reporting tools. This information may be linked to your registration information, and your navigation around the Sites may be tracked. We use this information to understand how the Sites are being used so that we can improve the Sites and offer appropriate products and services to our customers.

We use clear gifs in our HTML-based emails to count traffic from users who link to the Sites from the e-mails or determine readership statistics. This allows us to gauge the effectiveness of certain communications and the effectiveness of our marketing campaigns.

We also use Local Storage Objects (LSOs) such as HTML5 and Flash to store content information and preferences. Third parties with whom we partner to provide certain features on our Sites or display advertising based upon your Web browsing activity use HTML 5 to collect and store information. We partner with a third party to either display advertising on our Sites or manage our advertising on other sites. Our third party partner may use technologies such as cookies to gather information about your activities on our Sites and other sites in order to provide you advertising based upon your browsing activities and interests. Use of Google Analytics

We use Google Analytics, a web analytics service provided by Google LLC (“ Google”), to track and monitor how you use our Sites. In connection with use of Google Analytics, we use cookies to distinguish unique users by assigning a randomly generated client ID that is used to monitor and calculate visitor, session and campaign data for the Sites analytics report. We may also implement Google Analytics Demographics and Interest Reporting, a feature of Google Analytics Advertising, to help us understand the demographics and interests of our Sites’ users. The Sites may contain links to third party websites. This Privacy Policy applies solely to the Sites, the Services, and to the Personal Information collected. You acknowledge and agree that Company is not responsible for the privacy practices or the content of third party websites, for your use of any third party websites, or for any intended or unintended consequences of such use. We encourage you to carefully read the privacy statement of any Web site you visit. Please understand that some sites provide geographic choices when you enter the Site. Upon selecting a geographic area, however, you may be redirected to a different site, with a different privacy policy.

Children

The Sites and Services are intended for general use audiences and are not directed to children under the age of 13. Brother does not knowingly collect, disclose or use any Personal Information of individuals under 13 years of age. If we become aware that any user under the age of 13 has provided Personal Information to us, we will immediately delete such information.

International Visitors

The Sites and Services are hosted in the United States and all data collected from them are stored and processed in the United States. If you are visiting the Sites or using the Services from a non-US country that has privacy laws different from the United States, you understand and agree that Brother may collect, maintain, and process your data in the United States.

To facilitate our operations, we may transfer, store and process your Personal Information (as defined below) in jurisdictions other than where you live, including in the United States. Laws in these countries may differ from the laws applicable to your country of residence. For instance, if you are a European Economic Area (EEA) data subject and your Personal Information is shared with our affiliates, partners, or third-party service providers acting on our behalf outside of the EEA, then it is done so pursuant to necessary means to ensure an adequate level of protection.

(collectively “Brother”) complies with the EU-U.S. Data Privacy Framework (EU-U.S. DPF), the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework (Swiss-U.S. DPF) as set forth by the U.S. Department of Commerce. Brother has certified to the U.S. Department of Commerce that it adheres to the EU-U.S. Data Privacy Framework Principles (EU-U.S. DPF Principles) with regard to the processing of personal data received from the European Union in reliance on the EU-U.S. DPF and from the United Kingdom (and Gibraltar) in reliance on the UK Extension to the EU-U.S. DPF. Brother certified to the U.S. Department of Commerce that it adheres to the Swiss-U.S. Data Privacy Framework Principles (Swiss-U.S. DPF Principles) with regard to the processing of personal data received from Switzerland in reliance on the Swiss-U.S. DPF. Brother is responsible for the processing of personal data it receives, under the Data Privacy Framework, and subsequent transfers to a third party acting as an agent on its behalf. Brother complies with the Data Privacy Framework Principles for all onward transfers of personal data from the EU, United Kingdom, and Switzerland, including the onward transfer liability provisions.

The Federal Trade Commission has jurisdiction over Brother’s compliance with the EU-U.S. Data Privacy Framework (EU-U.S. DPF) and the UK Extension to the EU-U.S. DPF, and the Swiss-US Data Privacy Framework (Swiss-U.S. DPF). In certain situations, Brother may be required to disclose personal data in response to lawful requests by public authorities, including for the purpose of meeting national security or law enforcement requirements.

In compliance with the EU-U.S. DPF and the UK Extension to the EU-U.S. DPF and the Swiss-U.S. DPF, Brother commits to refer unresolved complaints concerning our handling of personal data received in reliance on the EU-U.S. DPF and the UK Extension to the EU-U.S. DPF and the Swiss-U.S. DPF to Truste, an alternative dispute resolution provider based in the United States. In all cases where Brother transfers personal information to a third party acting as a controller, Brother will comply with the Notice and Choice Principles. Brother will enter into a contract with the third-party controller that provides that such data may only be processed for limited and specified purposes consistent with the consent provided by you and that the recipient will provide the same level of protection as the Principles and will notify Brother if it makes a determination that it can no longer meet this obligation. The contract also provides that when such a determination is made the third party controller will cease processing or takes other reasonable and appropriate steps to remediate.

In all cases where Brother transfers personal data to a third party acting as an agent (processor for GDPR purposes), Brother will: (i) transfer such data only for limited and specified purposes; (ii) ascertain that the agent is obligated to provide at least the same level of privacy protection as is required by the Principles; (iii) take reasonable and appropriate steps to ensure that the agent effectively processes the personal information transferred in a manner consistent with the organization’s obligations under the Principles; (iv) require the agent to notify Brother if it makes a determination that it can no longer meet its obligation to provide the same level of protection as is required by the Principles; (v) upon notice, including under (iv), take reasonable and appropriate steps to stop and remediate unauthorized processing; and (vi) provide a summary or a representative copy of the relevant privacy provisions of Brother’s contract with that agent to the U.S. Department of Commerce upon request.

 

When we transfer your information to third parties we comply with the requirements of the legal protections that cover your information. For example, when we perform an onward transfer of your information protected under the GDPR, we remain responsible for the processing of your personal information. For information subject to an onward transfer by us under the Data Privacy Framework, we will remain liable under the Data Privacy Framework Principles if a recipient of your protected personal information processes such personal information in a manner inconsistent with the Principles, unless we are able to prove that we are not responsible for the event giving rise to the damage.

 

 

Assignment

We reserve the right to transfer any and all information that we collect from users to a third party in the event of any merger, sale, joint venture, assignment, transfer or other disposition of all or any portion of Brother’s assets or stock (including without limitation in connection with any bankruptcy or similar proceedings.

Your Privacy Rights

Right to Access Information

You have the right to request access to Personal Information collected about you and information regarding the source of that information, the purposes for which we collect it, and the third parties and service providers with whom we share it. To protect our customers’ Personal Information, we are required to verify your identity before we can act on your request.

Right to Request Deletion of Information

You have the right to request in certain circumstances that we delete any Personal Information that we have collected directly from you. To protect our customers’ Personal Information, we are required to verify your identity before we can act on your request. We may have a reason under the law why we do not have to comply with your request, or why we may comply with it in a more limited way than you anticipated. If we do, we will explain that to you in our response.

Right to Opt-Out of Sale of Personal Information

Right to Information Regarding Participation in Data Sharing for Financial Incentives

We may run promotions from time to time whereby we incentivize a consumer to share certain pieces of information with us; for example, we may offer a one-time discount if consumers sign up for our email marketing list. Participation in these incentives is voluntary and you may opt out of the data sharing at any time.

California's Shine the Light Act Rights

Residents of the California also have the right to request information regarding third parties to whom the company has disclosed certain categories of Personal Information during the preceding year for the third parties’ direct marketing purposes.

How to Submit a Request

You may submit a request to exercise your rights through one of the following means:

We will provide a response to your request within forty-five (45) days.

Before complying with a Right to Access or Right to Delete request, we will first contact you to verify your identity.

You may also designate someone else to make a request on your behalf. To protect your information, we will ask for a signed permission from you authorizing the other person to submit a request on your behalf. We will contact you to verify your identity before we respond to your authorized agent’s request.

Collection of Information

Through your use of the Messaging Service, we will receive Personal Information through our third-party service provider. “Personal Information” is information that individually identifies you, such as your mobile phone number you provided when signing up for the Messaging Service, any user or screen name that you select in connection with the Messaging Service, any comments or feedback regarding the Messaging Service that you send to us, or any other information that you choose to include in messages you send through the Messaging Service. When you send messages via the Messaging Service, we will also collect your messaging history and any information included in those messages.

 

We may also collect Personal Information about you using cookies or similar technologies. Cookies are pieces of information that are stored by your browser on the hard drive or memory of your device. Use of Information

We use Personal Information to deliver, analyze, maintain and support the Messaging Service. Sharing of Information
